Ebert <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Fotdel Creek Mine (Permit No. C-1982-056) Notice of Revision Application, Minor Revision 296 (MR296) <br />(HC #67400) <br />Dear Mr. Ebert: <br />Thank you for your email correspondence dated and received May 9, 2016 initiating consultation for the above <br />referenced undertaking pursuant to Section 106 of the National Historic Preservation Act and its implementing <br />regulations 36 CFR part 800. <br />We understand that the undertaking proposes to install, operate, and reclaim two new bore holes and includes <br />supplemental areas needed for access, utilities, and backdirt stockpiling. While three potential boreholes <br />locations (or pads) were included within your email notification, we understand from our telephone <br />conversation of May 1711, that only Options 1 and 2 are currently being considered for development. As the <br />potential conflicts associated with Option 3 with site 5R1'3325 was dropped, and in consideration of the <br />information that we currently have on file for the area of potential effects, it is our opinion that the undertaking <br />will result in no historic properties affected pursuant to 36 CFR 800.4(d)(1). <br />We request being involved in the consultation process with the local government, which as stipulated in 36 CFR <br />800.3 is required to be notified of the undertaking, and with other consulting parties. Additional information <br />provided by the local government or consulting parties might cause our office to re-evaluate our eligibility and <br />potential effect findings. Please note that our compliance letter does not end the 30 -day review period provided <br />to other consulting parties. <br />Should unidentified archaeological resources be discovered in the course of the undertaking, work must be <br />interrupted until the resources have been evaluated in terms of the National Register eligibility criteria (36 CFR <br />60.4) to consultation with our office pursuant to 36 CFR 800.13. Also, should the consulted -upon scope of the <br />work change please contact our office for continued consultation under Section 106 of the National Historic <br />Preservation Act. <br />We thank you for the opportunity to comment.
