Snowcap Coal has filed a Report of <br />Investigation (the "SCC Report") so as to comply with a DBMS Order dated October 16 <br />2015. This letter constitutes our response to that report. <br />James A. Beckwith, counsel for the I ontanari interests has provided you with a detailed <br />response to the SCC Report, with which we entirely concur and incorporate in this letter <br />by reference.. We have a particularly serious objection to the method of subsurface <br />testing employed by consultants for Snowcap Coal, namely electrical resistivity testing. <br />The testing which has been done in connection with the SCC Report does not provide <br />adequate information about voids and other conditions existing in the Mine. <br />We ask you to issue a supplemental order directing a meeting among affected property <br />owners, Snowcap Coal and DBMS so that an appropriate method of testing, to be paid <br />for by Snowcap Coal, can be determined and a further order issued by DRMS.
