The revision was submitted by New Elk Coal Company, LLC.
All review and comment periods as provided in the Act and the Regulations initiate from this date
of filing.

TR-19 proposes to revise Figure 14 within Exhibit 15 to show the altered schedule for pond
cleaning. It includes SEDCAD analyses to support this change of the figure. This revision does
not propose any on-the-ground changes at the mine site, nor does it change the Reclamation Cost
Estimate for the Lorencito Canyon Mine permit. The applicant is not proposing additional
surface disturbance outside of the area currently approved for disturbance.

The surface coal mining operation is on land located approximately 3 miles West of Segundo on
Hwy 12. The permit area is further described as follows:

Lands south of the Purgatorie River, lands east of Cow Canyon, lands north of the Puertecito
Canyon, and lands west of Little Jeff Canyon, covering approximately 3,142 acres.

The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle
map(s): Tercio.
