Exhibit S <br /> Peters 313 Permanent Man-made Structures <br /> John Peters owns a fence along the western boundary of the permit boundary. He also owns a private <br /> gravel road leading to a tank battery. <br /> EOG owns a cattle guard at the entrance to a tank battery. The cattle guard is within 200 feet of the <br /> permit boundary. <br /> Weld County owns CR 136.5 and a cattle guard adjacent to the permit boundary. Weld County will <br /> ensure repairs of any damages to either the cattle guard or County Road 136.5. <br /> The Oneok Bakken Pipeline is within 200 feet of the permit boundary. <br /> In addition, the proposed haul road will cross over four gas pipeline easements,one of which is owned <br /> by Kinder Morgan and three owned by Tallgrass Energy Partners. <br /> Agreements have been sent via certified mail to each structure owner. Proof of mailing and any <br /> agreements received are attached. <br /> In addition, an Engineering Evaluation of the area is attached in order to provide further details <br /> regarding the measures Weld County will be taking in order to protect all structures within 200 feet of <br /> the permit area. <br />
