The total area of these three tracts is 144.656+4.068+64.093 =212.817 acres. This information comes
from the Boundary Survey prepared by Landmark Engineering dated July 31, 2000.
As part of the original USR approval, Weld County required LRM to dedicate the 30 foot% ROW off of CR
54 and WCR 13. Deeds of Dedication for the LRM and CFF parcels were filed with Weld County and
accepted by the Weld County Board of Commissioners on June 2, 2002.
Due to additional set back requirements from Weld County, the mining boundary was set back an
additional 10 feet from the property boundary along CR 54 (SH 402)and WCR 13 for a total of 40 feet
from the centerline of CR 54 and WCR 13:the original permit drawings label this 40'future ROW setback.
Subtracting this additional 10 foot setback from the legal descriptions,the original permit area is 211.7
acres.
As part of this release request, the remaining area in the mining boundary has been determined using a
revised boundary survey for Tract A of the LRM property, the prior boundary survey for the strip of quiet
title land owned by LRM between Tracts A and e, and the prior boundary survey for Tract e owned by the
CFF. The following legal descriptions were derived from these boundary surveys.
LRM Tract A: 142.82 acres-This legal description takes into account the 50 foot% ROW setback from
CR 54 and the 50 foot% ROW setback from WCR 13.
Legal Description of a tract of land being Lot A of the Recorded Exemption No.0957-30-2-Re 134
recorded in Book 714 of Reception No. 1636088, records of the Clerk and Recorder, County of Weld,
being situated in Northwest Quarter of Section 30,Township 5 North, Range 67 West of the 6th
Principal Meridian, said County, State of Colorado being more particularly described as follows:
Beginning at the North One Quarter corner of said Section 30 and considering the North line of the
Northwest Quarter of said Section 30 as bearing S89°58'56"W and with all bearings contained herein
relative thereto;thence along the East line of the Northwest of said Section 30,S00°01'21"W,30 feet to
the True Point of Beginning, said True Point of Beginning being a point on the South line of State
Highway 402;thence continuing along said East line S00°01'21"W 2606.58 feet to the Southeast Corner
of the Northwest Quarter of said Section 30; thence along the South line of the Northwest Quarter,
S89°59'40"W, 1891.19 feet to a point on the easterly right-of-way of Hillsboro Ditch; thence along the
