This is also a formal request to withdraw our earlier partial <br /> release application dated January 13, 2016. This release request is for a total of <br /> 117.9 acres, leaving a total of 93.8 acres remaining in the mining permit boundary. <br /> Loveland Ready Mix concrete, Inc(LRM) is not requesting a reduction in the Financial <br /> Warranty. <br /> Attached are drawings showing the revised Mining and Reclamation Plans that <br /> identify the 117.9 acres LRM would like released from the Permit boundary. This <br /> 117.9 acres is land that has not been mined and will not be affected by mining or has <br /> already been reclaimed in accordance with the Permit requirements for wetlands <br /> mitigation. <br /> A majority of the acreage to be released is owned by LRM and has continually been <br /> used as agricultural range land during the entire duration of the Permit. <br /> After reviewing the original permit documents,we found a mining permit area of 210 <br /> acres was specified in the original permit application. However,after reviewing the <br /> Exhibits and the original boundary survey prepared at the time of the permit, it can <br /> be seen from the attached revised Exhibit A an actual 211.7 acres was included in the <br /> original Permit Area. <br /> The north east corner of the release area owned by LRM and the entire release area <br /> owned by the Croissant Family Trust has been successfully reclaimed to wetlands to <br /> meet the requirements of the Army Corps of Engineers Permit No. 200180205. As <br /> can be seen on page 8 of the Mitigation Wetland Annual Report, dated September <br /> 25, 2007,the total size of the mitigation wet meadow was determined to be 4.16 <br /> acres, in excess of the 3.05 acres required by the permit; and the total area of the <br />
