If the reservoir is constructed and then sold to an end-user, as indicated, then the new <br /> owner and the Engineer will be required to fulfill any remaining long term monitoring <br /> requirements under Rule 10. <br /> 16. Change in dam ownership must be reported to the SE0 in accordance with state statute <br /> CRS 37-87-104.5. <br /> Waivers: <br /> 17. Five SE0 rule waivers were granted in 2008 as part of the expired SE0 approval. Upon <br /> further review, we have determined that waivers are not required for borrow within 200- <br /> ft of the dam (Rule 5.10.1.4) or for absence of slope protection on the lower portion of <br /> the upstream slope (Rule 5.9.4.3.3) because your engineering analysis supports the <br /> proposed design in accordance with the respective rules. <br /> 18. Likewise we do not consider the wavier to Rule 15.3.2 to be relevant to SEO plan <br /> approval, as this rule pertains to long term monitoring requirements. Long term <br /> monitoring requirements are determined by the Long term monitoring plan (Rule 10) at <br /> the end of construction and by on-going regulation through the SEO's dam safety <br /> inspection program. <br /> 19. The following rule waivers are required prior to construction: <br /> a. Rule 5.10.1.4: Ownership or easement for minimum of 50-ft downstream or equal to <br /> the height of the dam. This waiver applies only to the west side of the dam where <br /> Nyberg Road provides a public right-of-way from which the dam toe can be accessed for <br /> maintenance and inspection. <br /> b. Rule 5.9.6.1.3: Pipe spillways are not allowed.
