According to the Division’s records, the following problems were to be resolved on <br />or before April 10, 2016 and have yet to been resolved. Listed below is the description and corrective <br />action for the two unresolved compliance problems. Please resolve the corrective actions and provide <br />evidence of such resolution on or before June 11 , 2016. <br /> <br />Note, if the corrective actions are not properly addressed, and no evidence is provided to the Division by <br />the date provided above, the listed problems could be escalated to the level of a possible violations and <br />would then be referred to the Mined Land Reclamation Board for further action. <br /> <br />Compliance Problem 1: <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Problem #1: The current mine plan needs to be updated <br />and clarified pursuant to C.R.S. 34-32.5-112 (1)(c)(VI). The operator must provide sufficient <br />information to describe or identify how the operator intends to conduct the operation. <br />CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required <br />$216 revision fee, to update and clarify the current approved mine plan to reflect existing and <br />proposed activities by the corrective action date. <br /> <br />Compliance Problem 2: <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem #2: There are structures within 200 feet of the <br />permit boundary which do not have structure agreements within the approved permit.
