Mine, were transferred from Peabody Coal Company to Seneca Coal Company, LLC
<br />on October 17, 1994. The third permit, C-94-082 for Yoast Mine, was issued to
<br />Seneca Coal Company, LLC on August 7, 1995. The Seneca II Permit has since been
<br />terminated and both the II -W and Yoast Permits are to be transferred to Seneca
<br />Property, LLC. Current, previous, and pending mining permits obtained by Seneca
<br />Property, LLC and its principal shareholders are listed in Appendix 3 -5.
<br />Legal Owners of Record of the Surface, Coal, Oil, Gas, and Other Minerals. The
<br />following lists the owners of record of the surface, coal, oil, and gas, and other
<br />minerals within the permit area of the Seneca II -W Mine. Exhibits 3-1, 3-2, 3-3, 3-4,
<br />and 3-5 depict the areas associated with these ownerships. Appendix 3-2 provides an
<br />alphabetical listing of the owners and their addresses. Appendix 3-3A lists the
<br />ownership by legal description as recorded at the Routt County Courthouse.
<br />Please note that mineral owners other than coal, oil, and gas, are the same as the oil
<br />and gas owners, except where noted in Appendix 3-3.
