We note that CDRMS is proposing Phase I release of 1.0 <br />acres associated with the West Mine Shaft and Phase II release of 13.1 acres associated with the <br />backfilled and regraded area of the West Mine and 10 .2 acres of the Timber Storage Area <br />associated with the East Mine for a total of 24.3 acres. <br />We have determined that the lands associated with the West Mine Shaft and West Mine area <br />were public surface lands managed by the Uncompahgre Field Office, Bureau of Land <br />Management (BLM). The lands associated with the East Mine were on private surface. The coal <br />mined was a combination of federal mineral estate managed by the BLM and private coal. <br />The acres included in the bond release area had improvements that served their useful purpose <br />and were no longer necessary since the associated coal resource had been mined out and the <br />mine had been abandoned. In addition, the reclamation appears to be properly carried out as <br />reported. <br />Because the reclamation has been shown to be successful the BLM has no objection to the Bond <br />Release.
