Previously submitted and approved with the original permit application and issued permit, and <br /> similarly provided for under this Amendment per the notification of adjacent landowners and <br /> attending Statement of Understanding. An engineer's evaluation on possible shadowing and <br /> mounding impacts are included with this submittal. The report evidences de minimus impacts <br /> that will not extend to surrounding lands. <br /> c. where such structure is a utility,the Applicant may supply a notarized letter, on utility letterhead, <br /> from the owner(s) of the utility that the mining and reclamation activities, as proposed,will have <br /> "no negative effect" on their utility. <br /> Previously submitted and approved with the original permit application and issued permit, and <br /> similarly provided for under this Amendment per the notification of adjacent landowners and <br /> attending Statement of Understanding. . <br /> 16. Please provide the Division with copies of the notarized structure agreements with all owners of the <br /> structures on and within 200 feet of the affected area of the site. <br /> All owners of record within 200 feet of the affected area were presented with an opportunity to sign <br /> such an agreement,ignore it as tacit approval,or object. The sole signed agreement is provided. An <br /> engineering evaluation provided and approved under the original application did not find any threats <br /> to adjacent structures. Nothing in this Amendment would alter that assessment. <br /> 6.5 Geotechnical Stability Exhibit <br /> 17. Please update the stability analysis completed for the Western Sugar Project permit application to <br /> include the proposed liner for the post mining configuration. <br /> The approved stability analysis report in the original application and its related conditions has not <br /> changed.
