At this time the Division has deemed your <br />application complete for review. <br /> <br />The decision date for your application has been extended at your request by 365 days to <br />allow you to address other local, state and / or federal permitting issues. The new decision <br />date for your application is May 3, 2017. Per the Act and Rules the public notice procedures <br />shall proceed despite the extended decision date. Newspaper publication of a notice <br />regarding the filing of your application and transmittal of a copy of the notice to all owners of <br />record of surface and mineral rights, holders of any recorded easements, and all owners of <br />record of lands that are within 200 feet of the boundary of the affected land is required <br />within 10 days after being called complete. You must submit proof of the notice and <br />mailings, such as Certified Mail - Return Receipt Requested, to the Division of Reclamation, <br />Mining and Safety within 45 days of this notice of completeness. Please review Construction <br />Materials Rule 1.6.2 (1) (d) and (e) for the notice requirements and feel free to contact us if <br />you have any questions. Additionally, any significant changes or additions to the application <br />on file in our office must also be reflected in the public review copy which has been placed <br />with the San Miguel County Clerk and Recorder. <br /> <br />The Division will review your application to determine whether it is adequate to meet the <br />requirements of the Act. We will contact you if additional information is needed. Please <br />contact the Division in writing if you wish to proceed to a decision prior to the May 3, 2017 <br />decision date. <br />
