<br />Dear
<br />Twentymile Coal, LLC (TC) is the owner, operator, and permittee under Permit No. C-1982-056 for the Foidel
<br />Creek Mine (Mine), located approximately twenty miles southwest of Steamboat Springs, Colorado. Mining and
<br />related activities are permitted through the State of Colorado - Division of Reclamation, Mining, and Safety
<br />(DRMS). TC has received the required permit approvals and has initiated development activities for mining of the
<br />Wolf Creek Coal Seam under portions of Sections 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 20, 21, and 22, T5N, R86W,
<br />as shown by the attached figure. The initial development activities are not expected to result in any ground surface
<br />subsidence, however, as ongoing development activities are completed, TC will initiate longwall mining activities.
<br />These activities will result in surface subsidence and may result in limited associated subsidence effects. Longwall
<br />mining will be initiated in Panel WC9-Right, under Section 11, T5N, R86W (State and Sage Creek Holdings
<br />surface ownership) in late August or early -September 2016.
<br />The only surface structures or facilities that would potentially be impacted by mining -related subsidence associated
<br />with mining in the Wolf Creek Coal Seam would be the Union Pacific Energy Spur, County Road 33, and the
<br />Yampa Valley Electric powerline paralleling RCR33. The powerline was constructed within an easement from TC
<br />which provides for and addresses any subsidence -related impacts. TC also has existing valid agreements with the
<br />Union Pacific Railroad and Routt County addressing monitoring and repair of any surface subsidence which may
<br />adversely impact the function and operation of the rail -line and road. With the exception of the noted structures,
<br />the overlying lands are generally utilized as rangeland for livestock grazing. Based on both detailed subsidence
<br />projections and the long history of longwall mining in the area, surface subsidence effects are expected to be
<br />minimal and would not adversely affect the existing land uses.
<br />Detailed information on anticipated subsidence effects and mitigation is provided in Section 2.05.6(6) of TC's
<br />Mining and Reclamation Plan permit document, copies of which are available for review at the mine -site, the
<br />offices of the CDRMS, and the Routt County Clerk ad Recorder's Office. The following are relevant contact
