USFS and Colorado State Division of Reclamation Mining and Safety Teams, <br /> Please review and provide response- <br /> Often the question of-"Is it mining' is asked of your team. <br /> When someone is digging,extracting the minerals from the deposit and selling those minerals-that normally would be considered mining and <br /> not merely"rock hounding"for personal collection. <br /> If the individual is extracting minerals from the ground and selling those minerals to the general public(sounds like mining to many who are <br /> aware of this specific situation)-that would normally require at least the following items: <br /> NOI-to your Team and to the Property owner-USFS-has any NOl been written and approved by the USFS for mining CMC276253 in Teller <br /> County Colorado on USFS property? <br /> Reclamation Bond and Mining Permit-normally via your team. We don't find a"Mining Permit"for CMC276253-if it does exist,where can we <br /> obtain a copy from? <br /> POO-reviewed and approved by the USFS and your team. Is there a P00 for CMC276253? Or even an NOl on file and approved by the USFS? <br /> 1. M2013044-where the Division of Mining Reclamation and Safety-scanned in the first correspondence from Mr. James"Eric"Hedricks-or at <br /> least only the Postage page of his letter,but not the contents of his letter asking questions. Where is the actual letter and why was that not <br /> scanned and made publicly available? (2013-07-12_PERMIT FILE-M2013044-is it mining.pdf document) <br /> 2. Colorado State Division of Mining Reclamation and Safety members inspected the site of CMC276253 and flagged it as illegal(unpermitted <br /> operation)on or about 07/16/2013. Attached are photos of the site.... The hole is HUGE,a serious safety issue. Please visit CMC276253 <br /> soonest-as the holes left by Mr.Hendricks are a serious safety hazard to the public-kids could be walking across the forest and fall into a very <br /> deep hole and seriously get hurt or killed. <br /> 3. The Inspection that was performed has N/A for Road,as well as N/A for fish and wildlife-(thus no"endangered species")and-the <br /> Gosshawk is not"endangered"-however that is a great ploy to stop a permit from being issued. <br /> 4.Please schedule a new Inspection of CMC276253 and CMC276254 based upon past inspection results and current photos provided. <br /> 5. The large amount of traffic to and from Mr.James E.Hedricks claims has resulted in a"new"and unauthorized roadway-is that bonded and <br /> permitted? Was the roadway approved by the USFS? <br /> 6. Attached is evidence that Claim owner is publicly offering to sell the mineralsthat he is and has been mining from the claims(CMC276253 and <br /> CMC276254)via numerous facebook pages. Selling minerals mined-commercial mining operations. Review numerous posts by Mr.Hedricks <br /> on FB-all offering to sell minerals-including those he claims were mined on his CMC276253 and CMC276254. State of Colorado staff has told <br /> me in the past-if you are extracting minerals and selling commercially-that is clearly commercial mining. <br /> 7. Please review/read publicly available document attached(from public post on FB): Erick_Hedricks FB_Post Aprii_6th_2016.PDF-please <br /> then also review the letter Mr.James Eric Hedricks mailed and that you have on file for M2016002(as found in your system- <br /> 2016-04-12_PERMIT FILE-M2016002 from Mr.James E.Hedricks). Bad feelings between folks-is not any valid reason to prevent approving <br /> permit for mining. The claim owner of CMC276253 and CMC276254 never applied for a Reclamation Bond,Mining Permit or any other type of <br /> paperwork-until the Prospectors show forced the issue and thus M2013044(unknown status). The owner of CMC251316-Mr.Donald Self is <br /> being above board,applying for permit,completing the required process,paperwork,fees,etc. There are so many professional people in the <br /> "mineral collecting"field that know Mr.Donald Self as being honest,having high integrity,being above board and doing the right thing. <br /> 8. Of course,due to the Prospectors show-eventually was a"Bond"posted for Reclamation of CMC276253 via Highnoon Entertainment as <br /> noted in document attached(downloaded from Colorado State website)-2013-07-18_PERMIT_FILE__M2013044.pdf for$3,000. What is the <br /> status of that"Bond"?
