Our <br />research has revealed that there is no viable official record of Powderhorn's underground mining <br />activity between 1981 and 1999. DRMS is only in possession of a 1978 Mine Map prepared and <br />filed by C.M.C. Mining Company. FOIA requests to the U.S. Department of Labor, Mining <br />Safety and Health Administration (MSHA) reveals that MSHA has no record of any map of <br />South Portal Mine or "Roadside South Mine" ever being filed. [Appendix C] The Mine Map <br />Repository, in Pittsburg, PA, has a copy of a 1999 South Portal Mine Map filed by Powderhorn <br />Coal but the copy quality is so poor as to be illegible. An informal request to Snowcap's <br />engineer, Mr. James Stover, for a copy of the 1999 Mine Map was refused by Mr. Stover. <br />Without a legible copy of a Final Mine Map, neither DRMS nor any landowner can <br />reliably determine the scope of the "...underground workings of the Roadside Mine (a/k/a South <br />Portal Mine)....".2 Since Snowcap will not voluntarily produce a legible copy, then Fontanari <br />must request that DRMS direct Snowcap to forthwith produce a legible copy. <br />Deficiency #2: Failure to Investigate All Fontanari Lands <br />Snowcap's Commitment No. 1 [12.21.15] was to determine the extent of hydrologic <br />communication of "...the properties overlying these working that belong to Mr. Rudolph <br />Fontanari and Mr. Jason Carey..." 3 Mesa County Assessor's Maps are available on-line via the <br />Mesa County GIS website.
