Room 5-W-215 <br />Arlington, VA 22202 <br />RE: REQUEST FOR PUBLIC RECORDS <br />5 U.S.C.§522 <br />SOUTH PORTAL MINE, MSHA 405-00281 <br />Dear Ms. Washington: <br />5460 WARD ROAD, Sun E 120 <br />ARVADA, CO 80002 <br />Pursuant to the Freedom of Information Act, request is herewith made for copies of the <br />following documents for the period 1999 to the date of this request: <br />Copies, including both printed and digital in " jpeg" format, of all Final Mine <br />Maps identifying the workings of the South Portal Mine, MSHA ID #05-00281, <br />said mine being situated. Inter alfa, in Secs. 34-36, T10S, R98W, 61' P.M., in <br />Mesa County, Colorado and operated, between 1977 and the present date by <br />Powderhorn Coal Company and Snowcap Coal Company, successively. The <br />South Portal Mine was formerly known as the "Roadside Mine". All active coal <br />mining operations ceased in 1999. <br />In order to assist you in determining my status, you should know that 1 am an attorney <br />representing Mr. Rudy Fontanari, and the Rudy and Carol Fontanari Revocable Living Trust: the <br />surface owners under which the South Portal Mine is situated. The maps sought are to be used in <br />company business. I am willing to pay fees up to a maximum of $250.00. If you estimate that <br />the fees will exceed this limit, please inform me prior to processing this request. <br />If you deny any part of this request, please cite each specific reason that you think <br />justifies your refusal to release the information. Please notify me of appeal procedures available <br />under the law. <br />
