Everist has submitted a request for partial acreage release for 161.01 acres permitted area of <br /> the Fort Lupton Sand and Gravel Mine, Permit No. M-1999-120. The area to be released contains <br /> two lined ponds, designated as Meadows Lake (aka Everist #1 Cell) and Meadows West Reservoir (aka <br /> Everist #2/4 Cell). The liner for the two ponds was approved by the State Engineer's Office on August <br /> 6, 2012 (re-confirmed on April 21, 2016) and on January 5, 2016 respectively. Also storage water <br /> rights were obtained for the Meadows Lake (aka Everist #1 Cell) and Meadows West Reservoir (aka <br /> Everist No. 2/4 Cell) in case no. 2013CW3080. <br /> The State Engineer's Office has no objection to the request for partial acreage release for the Fort <br /> Lupton Sand and Gravel Mine. Water shall not be impounded in the reservoirs except pursuant to <br /> lawful diversions allowed by statute or decree. At all other times, all inflow of water into the <br /> reservoirs from any source, including precipitation and ground water inflows, shall be removed by <br /> the applicant.
