April 28, 2016 <br /> Mr. Michael Cunningham <br /> Division of Reclamation, Mining& Safety <br /> 1313 Sherman Street, Room 215 AGGREGATE <br /> Denver, CO 80203 <br /> INDUSTRIES <br /> Re: Permit No. M-1977-141 —Lyons Quarry <br /> Technical Revision and Corrective Action Extension Requests <br /> Dear Michael: <br /> The Division previously approved an extension of time to May 2, 2016 to respond to two <br /> corrective action items identified in the Division's report of its March 2, 2016 inspection of <br /> Lyons Quarry. In response to the corrective action required for Revegetation, enclosed are a <br /> Technical Revision Request form, Weed Control Plan and check in the amount of$216. Steve <br /> Sauer, Boulder County's Weed Coordinator, and Aggregate's vegetation contractor,Foothills <br /> Vegetation, have reviewed and are in support of the proposed plan(see enclosed e-mail string). <br /> With regard to the corrective action for Sedmient Control, Aggregate Industries requests an <br /> additional extension of time to July 31, 2016 to install proposed erosion controls. As Christine <br /> Felz of Aggregate communicated to you earlier this week, she went out to the quarry with a <br /> contractor on Friday, April 22 to install erosion controls; however,the river was flowing high <br /> and they did not feel comfortable crossing, especially carrying hay bales and silt fence. Many of <br /> the rocks that were previously visible to cross over during the March inspection were under <br /> water. As stream flows will likely continue to increase over the next few weeks and are not <br /> likely to taper off until after spring runoff, it may be as late as July before the site can be safely <br /> accessed. Aggregate will continue monitoring stream levels and will proceed with installation of <br /> controls as soon as conditions safely allow. <br /> Thank you for your consideration.
