COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 <br /> May 2, 2016 <br /> Thomas Murray <br /> Lakewood Brick and Tile Company <br /> 1325 Jay Street <br /> Lakewood, CO 80214 <br /> RE: Church Pit; DRMS File No. M-1979-045; Technical Revision No.4—Adequacy Review No. 1 <br /> Dear Mr.Murray, <br /> The Division of Reclamation, Mining and Safety(Division)received Technical Revision-04(TR-04) for <br /> the above referenced site on April 7,2016.The decision date for this Technical Revision is May 9,2016. <br /> The Division has reviewed the proposed revisions and has the following comments: <br /> 1. The Reclamation Plan Map contains labels for the final grade of the west and east slopes of the pit. <br /> Please revise the map to include labels for the final grade of the north and south slopes. <br /> 2. The elevation of the labeled contour lines on the Reclamation Plan Map appears to be off by ten feet. <br /> Please revise the Reclamation Plan Map accordingly. <br /> 3. The Operator is proposing to eliminate `staging' for the permit. Please clarify if this refers to the <br /> phased Mining and Reclamation Plan. If mining and reclamation of the site will not occur in phases, <br /> the Operator must provide the Division with a revised Mining Plan Map to reflect the increased depth <br /> of the pit and to illustrate the grade at which the pit walls will be mined. In addition,the revised <br /> Mining Plan Map should illustrate the direction and sequence of mining as it relates to the two <br /> extraction operations. <br /> 4. As noted above,the Operator is proposing to change components of the Mining and Reclamation <br /> Plans. Therefore,the Mining and Reclamation Plans must be revised to reflect these changes. Please <br /> provide a revised Mining and Reclamation Plan to update and clarify how the operation will be <br /> conducted. <br /> 5. Pursuant to Rule 6.4.19,where the mining operation will adversely affect the stability of any <br /> significant, valuable and permanent man-made structure located within two hundred feet of the <br /> affected land,the Applicant/Operator may provide a notarized agreement between the Applicant and <br /> the person(s)having interest in the structure. The agreement shall establish that the Applicant is to <br /> provide compensation for any damage to the struture. A review of the permit file found the Division <br /> has no record of a structure agreement for the Upper Church Ditch and the McKay Ditch.
