The decision date for this Technical <br /> Revision is May 6, 2016. The Division has reviewed the proposed revisions and has the <br /> following comments: <br /> 1. The Reclamation Plan Map contains labels for the final grade of the east slope of the pit. <br /> Please revise the map to include labels for the final grade of the north, south and west slopes. <br /> 2. The elevation of the labeled contour lines on the Reclamation Plan Map appears to be off by <br /> ten feet. Please revise the Reclamation Plan Map accordingly. <br /> 3. Pursuant to Rule 6.4.19, where the mining operation will adversely affect the stability of any <br /> significant, valuable and permanent man-made structure located within two hundred feet of <br /> the affected land, the Applicant/Operator may provide a notarized agreement between the <br /> Applicant and the person(s) having interest in the structure. The agreement shall establish <br /> that the Applicant is to provide compensation for any damage to the struture. A review of the <br /> permit file found the Division has no record of a structure agreement for the Upper Church <br /> Ditch and the McKay Ditch. Please provide a signed and notarized structure agreement for <br /> the ditches. Alternately, the Operator may submit an engineering evaluation which <br /> demonstrates the ditches will not be damaged by activities occuring at the mining operation. <br /> 4. What offsets will be maintained between the limit of mining and the relocated ditches? <br /> 5. The Reclamation Plan Map shows the pit walls will be reclaimed at 2H:IV. The currently <br /> approved final grade of the pit walls is 3H:1V. In Technical Revision No. 1, the Operator <br /> acknowledged that it would be difficult to establish vegetation on a 2H:1 V slope and changed <br /> the final grade to 3H:IV. The Division concurs that establishing vegetation on 211:1 V slope <br /> is difficult.
