<br /> We have received your December 21, 2015 request on behalf of Stonewall Springs Quarry, LLC
<br /> ("Applicant" or "Stonewall" or "EWSD I, LLC"), for renewal of a substitute water supply plan
<br /> ("SWSP") that allowed the temporary use of the dewatering water from the Pueblo East Pit at
<br /> Evans #2 for irrigation. The previous SWSP was approved for the period August 20, 2015
<br /> through March 31, 2016. This request is submitted pursuant to S37-92-308(5), C.R.S., and
<br /> notice was given to the subscribers of the Division 2 SWSP notification list on December 21,
<br /> 2015. No comments were received during the statutory 35 day notice period. The $300 filing
<br /> fee has been paid under receipt no. 3672744.
<br /> An application for approval of a plan for augmentation as proposed under this SWSP has not
<br /> been filed with the water court and the depletions associated with the proposed plan will not
<br /> exceed five years, therefore this request has been submitted pursuant to 537-92-308(5),
<br /> C.R.S.
<br /> No diversions were made under the first two SWSPs approved for the period August 20, 2014
<br /> through August 19, 2015 and August 20, 2015 through March 31, 2016; however, pursuant to
<br /> 537-92-308(5)(b)(1), C.R.S., "In no event shall any plan approved pursuant to this subsection
<br /> (5) or any water use included in such plan be approved or renewed for more than five years."
<br /> Therefore, any subsequent renewals of this SWSP will not allow pumping to occur beyond
<br /> March 31, 2018, such that stream depletions will not extend beyond August 19, 2019.
