Twentymile Coal, LLC. <br />Page 2 <br />April 27, 2016 <br />ii. - Please update section 2.03.6 of the permit to add a section regarding the Wolf <br />Creek Reserve, and provide a list of the documents (including the newly <br />approved lease by modification) upon which TC bases its legal right to enter and <br />begin mining. <br />New adequacy review items based on response: <br />1. PR -10 modifies the mining plan that was approved with PRI 1, the panels proposed to be <br />developed and mined with PR -10 are WC 5RT to 9RT. Please revise the text on proposed revised <br />page 2.05-3, under the Wolf Creek Reserve section, to indicate mining will occur in 5RT to 6RT <br />and WC 5RT through 9RT panels. <br />2. Page 2.05-3.1 indicates that TC is pursuing leasing of the federal coal under "COC -54608 for <br />Sections 21, 22 and 23, TSN, R96W in conjunction with mining plans for the Wolf Creek <br />Reserve." The range discussed in the description should be R86W. Please revise accordingly. <br />3. On page 2.05-3.1, please specifically state that TC obtained a lease modification for coal located <br />in the WCR in portions of section 21 and 22 of TSN, R86W as specifically described in the <br />modified coal lease effective April 1, 2016. Then please clarify that TC will be seeking an <br />additional lease for coal within the WCR in section 23 of TSN, R86W. <br />4. Page 2.05-11.2 needs to be updated to include the 16 -Left Utility Borehole, 17 — Left Cement <br />Borehole, 5 -Main North Cement Borehole and the 13 LT Outby Utility Borehole. <br />5. Proposed revised page 2.05-97.4 needs to be updated to include a new paragraph added from the <br />approval of MR290 regarding the new topsoil stockpile for the CRDA. With the addition of this <br />paragraph the subsequent pages will need to be revised so this section remains consistent and <br />complete. <br />This concludes the Division's review of TC's response to our fifth adequacy review letter. The decision <br />date for PR10 is May 20, 2016.
