Enclosed is the Division's decision form and written findings. The proposed <br />decision will be published in the Delta County Independent, as soon as possible. Publication of <br />the notice initiates a thirty-day public comment period. If there are no requests for an <br />adjudicatory hearing within the thirty days, the decision will become final. <br /> <br />SL-5 approved the Phase I release of 1.0 acres associated with the West Mine Shaft and Phase II <br />release of 13.1 acres associated with the backfilled and regraded area of the West Mine and 10.2 <br />acres of the Timber Storage Area associated with the East Mine. As provided by Rule 3.03.2(6), <br />should you object to the Division's proposed decision, you may request an adjudicatory hearing. <br /> <br />If you have questions or are in need of additional information, please contact me. <br />
