Case 16-42529 Doc 149 Filed 04/15/16 Entered 04/15/16 16:16:59 Main Document <br />Pg5of71 <br />(4) authorization for the Debtors to continue to use Cash Collateral (as <br />defined below) and all other Pre -Petition Collateral (as defined below) in which <br />any of the Pre -Petition Secured Parties has an interest, and the granting of <br />adequate protection in the form of the Adequate Protection Obligations and the <br />Adequate Protection Liens to the Pre -Petition Secured Parties, as applicable, with <br />respect to, inter alia, such use of their Cash Collateral and all use and diminution <br />in the value of such Cash Collateral and the Pre -Petition Collateral, as applicable; <br />(5) approval of certain stipulations in paragraph 4 of this Interim Order by <br />the Debtors with respect to the Existing Secured Agreements and the liens and <br />security interests arising therefrom; <br />(6) the granting of superpriority claims under section 364(c)(1) of the <br />Bankruptcy Code to the DIP Lenders payable from, and having recourse to, all <br />pre-petition and post-petition property of the Debtors' estates and all proceeds <br />thereof (including, subject only to and effective upon entry of the Final Order (as <br />defined below), any Avoidance Proceeds (as defined below)), subject to the Fees <br />Carve Out (as defined below) and the Bonding Carve Out (to the extent provided <br />herein); <br />(7) subject only to and effective upon entry of the Final Order and without <br />prejudice to paragraph 27(c), the limitation of the Debtors' right to surcharge <br />against collateral pursuant to section 506(c) of the Bankruptcy Code; <br />(8) pursuant to Bankruptcy Rule 4001, that an interim hearing (the <br />"Interim Hearing") on the Motion be held before this Court to consider entry of <br />an order granting the Motion on an interim basis (as entered on the docket, the <br />5 <br />
