Case 16-42529 Doc 108 Filed 04/14/16 Entered 04/14/16 17:28:56 Main Document <br />Pg 59 of 70 <br />limitation, for lender liability or pursuant to section 105, 502(d), 510, 544, 547, 548, 549, 550, <br />or 552 of the Bankruptcy Code, applicable non -bankruptcy law or otherwise, (b) investigate, <br />assert or prosecute any Claims and Defenses or causes of action against the DIP Agent, the DIP <br />Lenders, the Pre -Petition Agent, the Pre -Petition Lenders, the Second Lien Notes Trustee or <br />the Second Lien Noteholders and/or their respective Representatives, (c) prevent, hinder or <br />otherwise delay the DIP Agent's, the DIP Lenders', the Pre -Petition Agent's, the Pre -Petition <br />Lenders', the Second Lien Notes Trustee's or the Second Lien Noteholders' assertion, <br />enforcement or realization against or upon the Cash Collateral or the Collateral in accordance <br />with the DIP Documents, the Existing Credit Documents, the Existing Second Lien Indenture <br />Documents or this Interim Order, (d) seek to modify any of the rights granted to the DIP <br />Agent, the DIP Lenders, the Pre -Petition Agent, the Pre -Petition Lenders, the Second Lien <br />Notes Trustee or the Second Lien Noteholders hereunder or under the DIP Documents or the <br />Existing Secured Agreements, in each of the foregoing cases without such applicable parties' <br />prior written consent, (e) attempt to directly or indirectly modify any of the rights granted to <br />the DIP Lenders or the DIP Agent, (f) pay any amount on account of any claims arising prior to <br />the Petition Date unless such payments are (i) approved by an order of this Court and (ii) in <br />accordance with the DIP Documents and the 13 -Week Projections; provided that, (A) the <br />Debtors may, in all cases set forth above, challenge the assertion or existence of an Event of <br />Default hereunder or under the DIP Facilities, (B) advisors to the Creditors' Committee may <br />investigate the claims and liens granted pursuant to the Existing Credit Documents or the <br />Existing Second Lien Indenture Documents during the Challenge Period and prosecute any <br />causes of action in connection therewith at an aggregate expense for such investigation and <br />prosecution not to exceed $50,000, (C) the foregoing limitations shall not apply to any <br />59 <br />
