Related to Docket No. 23 Main Document INTERIM ORDER, PURSUANT TO SECTIONS 105(a), 363 AND 364 OF THE BANKRUPTCY CODE (1) AUTHORIZING THE DEBTORS TO MAINTAIN, CONTINUE AND RENEW THEIR SURETY BOND PROGRAM AND (II) GRANTING CERTAIN RELATED RELIEF; AND (III) SCHEDULING A FINAL HEARING This matter coming before the Court on the Motion of the Debtors and Debtors in Possession, Pursuant to Sections 105(a), 363 and 364 of the Bankruptcy Code, for Interim and Final Orders (1) Authorizing the Debtors to Maintain, Continue and Renew Their Surety Bond Program and (lI) Granting Certain Related Relief (the "Motion");' the Court having reviewed the Motion, the First Day Declaration and having considered the statements of counsel and the evidence adduced with respect to the Motion at a hearing before the Court (the "Hearing"); and the Court having found that (i) the Court has jurisdiction over this matter pursuant to 28 U.S.C. §§ 157 and 1334 and Rule 81-9.01(B)(1) of the Local Rules of the United States District Court for the Eastern District of Missouri; (ii) venue is proper before this Court pursuant to 28 U.S.C. §§ 1408 and 1409; (iii) this is a core proceeding pursuant to 28 U.S.C. § 157(b); (iv) the Debtors having represented that adequate and proper notice of the Motion has been given and that no other or further notice need be given; (v) the Debtors maintain, continue and renew the Surety Bond Program in the ordinary course of their businesses; (vi) sound business reasons exist that Capitalized terms not otherwise defined herein shall have the meanings given to them in the Motion. 75922-2
