Stream Buffer Zones <br />Introduction <br />According to Rule 4.05.18, no land within 100 feet, or greater if required by the Division, of a <br />perennial stream, an intermittent stream, or an ephemeral stream with a drainage area greater <br />than one square mile, shall be disturbed by surface and underground coal mining operations <br />unless the Division specifically authorizes surface or underground mining operations closer to, or <br />through such a stream. Additionally, the area not to be disturbed shall be designated a stream <br />buffer zone and marked as specified in Rule 4.02 within the permit boundary. <br />From a historical perspective, various disturbances have occurred within 100 feet of perennial <br />streams, intermittent streams, or ephemeral streams with a drainage area greater than one square <br />mile. The locations of the disturbances that are described below are depicted on Map 4.05.18-1. <br />Calamity Draw <br />Pump Station <br />The Calamity Draw pump station is a temporary installation consisting of a sump, water pump, <br />and water lines. During installation and to date, this station has not created any adverse impacts <br />to Calamity Draw. The pump station is used to withdraw irrigation water from Calamity Draw. <br />New Horizon Mine has provided a demonstration (see attached SEDCAD) to show that <br />sedimentation ponds or other facilities are not necessary for the drainage to meet the effluent <br />limitations of 4.05.2. In accordance with Rule 4.05.2(3)(a), this demonstration meets the criteria <br />for an exemption from the requirements of 4.05.2. <br />Ditch C-18 <br />Portions of Ditch C-18 were constructed inside the stream buffer zone for Calamity Draw. <br />During construction and to date, this has not created any adverse impacts to Calamity Draw. As <br />constructed, Ditch C-18 functions as a collection ditch which captures surface water runoff from <br />the disturbed and reclaimed areas and conveys surface runoff to an approved sediment control <br />structure (Pond 007). <br />Pond 007 <br />A portion of the Pond 007 outfall was constructed inside the stream buffer zone for Calamity <br />Draw. During construction and to date, this has not created any adverse impacts to Calamity <br />Draw. In accordance with Rule 4.05.18, the pond location within the buffer zone has not caused <br />or contributed to a violation of applicable water quality standards. As built, the pond is capturing <br />all surface water runoff from mining operations and discharging them through an approved <br />outfall location which is in compliance with New Horizon's mine current water quality discharge <br />permit.
