Rob Zuber <br />April 19, 2016 <br />Page 3 <br />7) Within the 2012 subsidence repair area near the Thompson driveway a significant <br />amount of Mullein and cheat grass were seen. Also, a new subsidence hole is developing <br />and is now approximately two feet deep in places. These issues must be addressed by <br />EFCI. <br />Response: The alleged infestation of annual weeds in the subsidence repair area (Mullein and <br />cheat grass) are not an issue with the landowner. TCC has withdrawn its demand, as part of the <br />Agreement, that the weed infestation be treated. The subject subsidence "hole" is possibly a <br />result of fill settling at the location of a hole backfilled during the 2012 repair project. In any <br />case, the observed depression in the ground and minor surface cracks do not adversely impact the <br />post -mining land use. There is no evidence to conclude that the depression will increase in <br />extent, and any efforts to mitigate the current condition would result in unnecessary new <br />disturbance. <br />8) The 2012 subsidence repair area has not met the liability time frame for Phase III <br />release. <br />Response: EFCI reasserts, and again respectfully requests, that the multiple areas comprising the <br />subsidence repair work done in 2012 be considered site maintenance rather than additional, new, <br />disturbance. As such the repair area is not subject to the minimum 10 -year time frame for <br />vegetation success. <br />9) Near the intersection of CR15 and CR92, on Warnock property outside the permit <br />boundary, there are small concrete pads and rebar that are remnants of a former sign <br />owned by EFCI.
