(EFCI) has reviewed your adequacy review questions in your letter of April <br />13, 2016, regarding EFCI's application for Bond Release Request No. 04 (SL -04). This letter is <br />intended to provide all the requested information necessary to approve SL -04. Each DRMS <br />adequacy question is repeated for reference (by number), shown in bold, and followed by EFCI's <br />response. <br />1) Regarding the seep and associated structure in the Magpie Diversion, please provide a <br />status update on the plan to address (possibly remove) this structure. <br />Response: EFCI will reclaim the Magpie spring structure, and has requested Kessler <br />Reclamation to perform the work. The Corley Company (TCC) has requested removal of the <br />structure as part of a reclamation agreement between TCC and EFCI, dated April 18, 2016, <br />hereinafter referred to as the Agreement. <br />2) The Corley replacement well produces water with high levels of iron and manganese, <br />per laboratory results for a sample taken by EFCI. During the inspection, Dr. Corley <br />illustrated this with a sample that he said he had taken approximately four days earlier; <br />the water in the bottle contained a brown precipitate at the bottom. A water sample was <br />also taken from the well during the SL -04 inspection; this water became turbid after <br />approximately an hour. Because this water is apparently not potable, the Division <br />questions if this well is a valid replacement for the former well. Please provide a status <br />update on this issue. <br />Response: EFCI has committed, as part of the Agreement, to specifically provide a lump -sum <br />payment for a water treatment system to mitigate the quality of water produced from the subject <br />well. Replacement of the former well, therefore, is not an EFCI responsibility. <br />
