(Tri-State) has received your <br />review letter of the 2014 Annual Reclamation Report (ARR), dated March 16, 2016 and provides <br />the following responses to your comments on behalf of the Western Fuels -Colorado, A Limited <br />Liability Company (Western Fuels -Colorado) New Horizon North Mine. <br />1. On page 1, A -Rule Requirements, it states that Rule 2.04.13(1)(afi states, by February 15, <br />or such date agreed on, each permitted shall file an annual reclamation report. The NHN <br />permit states that WFC will file an annual reclamation report by March 15 of each year. <br />Please amend this statement in future. <br />Response: Tri-State believes the statement as provided is correct citation of the applicable <br />rule, and it will remain in the ARR document. Nevertheless, some additional text will be <br />included in the 2016 ARR to clarify the permit commitment date versus requirement of Rule <br />2.04.13(1). <br />2. In the permit on Table 2.05.4(2)(d)-1, neutralization potential ratio (NPR) is a bench 1 <br />suitability parameter. NPR was not reported in the soil sample results in Appendix 1. <br />Please submit NPR for the two sample points taken.
