The Division reviewed <br />your responses and has the following additional questions: <br />Section 2.04.9 — Soil Resource Information <br />1. Item Resolved. <br />2. Topsoil placement zones 5-8 have been added to Map 2.05.4-9 and Map 2.05.4-7 will be removed from <br />the permit. The topsoil volume information that was added to Map 2.05.4-9 from Map 2.05.4-7 is <br />inconsistent. For example, topsoil pile 4 on Map 2.05.4-7 is labeled as having 13,266 cy and on Map <br />2.05.4-9 it is labeled with 15,123 cy. There is also a difference in volumes for topsoil piles 12A, 12B, <br />12C, 12D, 12E and 12F. Please clarify why the topsoil volumes are different. <br />Section 2.05.3(3) — Mine Facilities <br />This item was corrected as requested in the first adequacy letter for TR -70. Since the first adequacy letter <br />was submitted to Tri-State, the comment period on MR -98 closed and the revised pages were <br />incorporated. The revisions of MR -98 changed the pagination of Section 2.05.3(3). Please re -submit the <br />proposed changes of TR -70 in the new format that was incorporated with MR -98. <br />2. Item Resolved. <br />3. Based on the March 21, 2016 submittal, the IP Tailwater Ditch 1 and the IP Tailwater Ditch 2 are <br />included with the Pond 009 design. According to Map 2.05.3(3)-1, these two ditches flow to the <br />proposed Pond 016. According to the submitted Table 2.05.3(3)-1 and Attachment 2.05.3(3)-30 the <br />design for Pond 009 includes the designs for the Tailwater ditches. Additionally, Attachment 2.05.3(3)- <br />29 includes the tailwater ditch as a part of the Pond 016 design.
