\1� <br /> V <br /> Mr.Wally Erikson <br /> Colorado State Division of Reclamation, Mining and Safety RECEIV7 <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 APR 18 2016 <br /> Subject: Letter of Objection to the Approval of Permit Application#M2016010 DIVISION OF P,,E <br /> MINING AK, <br /> Dear Sirs, <br /> We are aware of the public notice posted by the Transit Mix Concrete Company;that they have applied <br /> for a mining permit to open an open pit quarry and aggregate production facility described in permit <br /> application#M2016010. <br /> My wife and I are residents of the Red Rock Valley Estates(RRVE) in Colorado Springs,CO. Our home is <br /> located approximately one mile NE of the proposed open pit quarry. <br /> We wish to formally object to the approval of this quarry on multiple ground,fist that we will be directly <br /> and adversely affected and aggrieved by the proposed conduct of this mining operation on the basis of <br /> the significant risk it poses to the quality and availability of our existing water supply,specifically the <br /> Deadman's Creek drainage and watershed.This impact is both to the fracturing system that feeds our <br /> subsurface supply upstream and the surface water as well. <br /> We wish to present geologic and hydrologic data citing both reference material within the Transit Mix <br /> application and data overlooked or ignored from the Red Rock Valley Estates Water Districts s Source <br /> Water Protection Plan,and other sources at your Public Hearings. Our water supply comes from duty <br /> wells shared by all of us in the water district. <br /> We also want to point out that, contrary to Transit Mix Application Exhibit P (Municipalities Within Two <br /> Miles)the Southern Colorado Springs RRVE Water District is a Quasi-Municipal Corporation and political <br /> Subdivision of the State of Colorado. It operates under the authority of the Special District Act, C.R.S. <br /> 32-1-1-101,et.seq. My point is,Transit Mix has, unfortunately,overlooked this entire community at <br /> best, rendering it"invisible" at best to your body in the consideration of the impacts of this application. <br /> We also object and are aggrieved by the predictable loss of property value that will be inevitable should <br /> this permit be approved. I will, again, present evidence and documentation in your public hearing to <br /> illustrate from the realtor industry that similar open pit quarry operations have caused a palpable loss of <br /> property value and suppressed the normal buying and selling of properties within the shadow of this <br /> type of operation.We did not move here 10 years ago with the reasonable expectation that our equity <br /> and investment in land and property would stripped away,along with the several hundred other <br /> neighbors surrounding this proposed activity,without fighting an expensive and lingering legal battle. <br /> While we have reasonable concerns about road safety, noise and dust as well,the principal basis of our <br /> objection is focused on those two issues. <br /> Thank you for your consideration. <br /> Respectfully, <br />
