COUNT EIGHT <br /> In the event the Court does not find that there <br /> 2 <br /> exists a public road or a private road over the real pro- <br /> perty described in Counts One to Seven, inclusive, and <br /> finds against the Plaintiff and the Defendants, other than <br /> Defendant George Hutchison, on the issues in Counts one to <br /> .even, inclusive, then the Plaintiff as its Count Eight <br /> against the Defendant Hutchison and in favor of all of the. <br /> Defendants save Defendant Hutchison, states and avers: <br /> 1. The Plaintiff owns the real property described <br /> in paragraph 1 of Count one of this Complaint- <br /> 2- The Defendants, other than the Defendant George <br /> Hutchison, own the real property described in paragraph 2 <br /> of Count One as belonging to such Defendants respectively. <br /> 3.. The properties owned by the Plaintiff and the <br /> Defendants, other than Defendant Hutchison, are served by a <br /> road which begins at a point approximately 12 miles south <br /> of the city lit-sits o- the City of Colorado Springs, Colo- <br /> rado, on State Highway 115, which road diagonally trans- <br /> verses in a Northwesterly direction across Sections 15, 16, <br /> 17, 8 and 7 in Township 16 South, Range 67 West of the 6th <br /> P.M., El Paso County, Colorado, to points on the boundary <br /> lines of Sections 7 and 8 in Township 16 South, Range 67 <br /> West of the 6th P.M_, all of said property being in E1 <br /> Paso County, Colorado. .An exact description-of the property <br /> involved and the exact description of the road above set <br /> -10- <br /> EZ/LI 39dd 3ISWIN 68006696TL bE:EZ 9I0Z/LZ/E0 <br /> EXHIBIT 3 <br />
