EXHIBIT <br />c. Physical locations (maps and coordinates) of the proposed alternate selenium points of compliance for <br />Ponds 002 and 004; <br />d. List of potential interim measures to be implemented during the spring of 2013 including, but not limited <br />to: straw bales inserted into incised channels located within the wetlands downstream of Pond 002; <br />develop, design, and plan to install `spreader' piping to distribute discharge from Pond 002 throughout <br />downstream wetland; develop planting plans and schedules for the wetland systems below Ponds 002 <br />and 004; develop plans to limit cattle grazing in areas in proximity to Ponds 002 and 004. <br />Milestone 2- Selenium treatment options, due April 30, 2013 <br />I. Peabody shall submit a comprehensive evaluation of selenium treatment options. This evaluation shall <br />consider the following: <br />a. Wastewater treatment techniques, technologies, and/or systems designed to treat selenium; <br />b. Water quality and quantity analysis, the need for pre- or post-treatment, construction and maintenance <br />requirements, capital and operational costs, and a comparison with existing case -studies, as related to <br />Ponds 002 and 004; <br />c. The feasibility and reasonableness of utilizing these treatment techniques, technologies, and/or systems <br />to reduce the selenium concentrations in the effluent from Ponds 002 and 004. <br />Milestone 3- Pond 004 wetland map, due July 31, 2013 <br />I. Peabody shall submit a map that delineates the extent and composition of the wetlands below Pond 004. <br />Milestone 4- Pond 004 wetland jurisdictional determination request, due August 31, 2013 <br />I. Peabody shall submit to the Division a copy of Peabody's request to the USACE for the preliminary <br />jurisdictional determination ("JD") for the wetlands below Pond 004. <br />Milestone 5- USACE JD decision, due November 30, 2013 <br />I. Peabody shall submit a copy of a letter from the USACE regarding the JD decision on the wetlands below <br />Pond 004. The letter shall include a copy of the map that delineates the wetland boundary. If the USACE <br />has not made a final decision, then Peabody shall provide an estimated schedule for the final USACE <br />decision. <br />Milestone 6- Long-term measures proposal, due February 28, 2014 <br />I. Peabody shall submit a comprehensive -technical report for all activities conducted during 2013. This report <br />shall include, but is not limited to, a summary of activities conducted, an analysis of field data and <br />observations, an evaluation of contributing selenium sources, and an evaluation of the performance of the <br />short-term measures employed in 2013. <br />II. Peabody shall submit a report that identifies the specific long-term measures that Peabody will undertake to <br />produce effluent from Ponds 002 and 004 that consistently complies with the Permit.
