Box 1484 <br />Idaho Springs, CO 80452 <br />RE: Phoenix Mine; DRMS File No. M-1982-075; Technical Revision No. 3; Adequacy <br />Review No. 1 <br />Dear Mr. Mosch, <br />The Division of Reclamation, Mining and Safety (Division) received Technical Revision - 3 <br />(TR -03) for the above referenced site on March 23, 2016. The decision date for this Technical <br />Revision is April 22, 2016. The Division has reviewed the proposed revision and has the <br />following comments: <br />1. The Operator has identified how the various surface facilites will be reclaimed. On February <br />22, 2016, the Division issued a financial warranty increase to account for the demolition of <br />structures and the removal of refuse. The actions the Operator has outlined will result in a <br />decrease of the financial liability associated with reclaiming the site. The Division will <br />withdraw the surety increase to allow the Operator time to complete the proposed <br />reclamation activities if the Operator provides the Division with a reasonable timeline for <br />completing such actions. In absence of a timeline to complete the proposed activities, the <br />increased financial warranty will be due on April 22, 2016. <br />2. The Operator has proposed leaving the fuel tanks in place. The fuel tanks are not historic <br />structures, nor are they unique to underground mining operations. The Division requests the <br />Operator commit to removing the fuels tanks. Alternately, the fuel tanks may remain if they <br />are decomissioned by drilling or cutting holes into the bottom of the tanks. Photographs may <br />be used to demonstrate the fuel tanks have been decomissioned. Please respond. <br />3. The Operator has requested to leave the historic mine building in place so that it may be used <br />for the mine tours. Please provide documentation from the county which demonstrates the <br />structure is in conformance with local zoning requirements. <br />4. The Division recommends that the Opertor carefully document the removal of scrap metal <br />and refuse from the site.
