COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />April 11, 2016 <br />Ms. Christine Belka <br />Senior Regulatory Program Specialist <br />OSMRE — Denver Field Division <br />1999 Broadway, Suite 3320 <br />Denver, CO 80202-3050 <br />RE: Supplemental Response to Ten Day Notices and Citizen's Complaint — Peabody <br />Energy Self -Bonds in Colorado; TDN #X16-140-182-001, #X16-140-182-002, #X16- <br />140-182-003, #X16-140-182-004, and #X16-140-182-005 <br />Dear Ms. Belka: <br />On March 29, 2016, pursuant to 30 C.F.R. 5842.1 t(b)(1)(ii)(B)(4)(i), the Colorado Division of <br />Reclamation, Mining and Safety (Division) provided its response to the five Ten -Day Notices <br />(TDNs) issued by the Office of Surface Mining, Reclamation and Enforcement (OSMRE) in <br />response to a citizen's complaint from WildEarth Guardians (WEG Complaint) on February 8, <br />2016. This letter provides supplemental information regarding the alleged violations, as the <br />Division's bonding situation with the five Peabody mines that were noted in the TDNs has <br />changed. <br />On April 1, 2016 the Division received corporate sureties for the five Peabody mines noted in the <br />TDNs: Williams Fork, Foidel Creek, Seneca II -W, Yoast, and Peabody Sage Creek. The <br />corporate sureties are for the full liability amount for each mine. On April 8, 2016 the Division <br />accepted the corporate sureties for all five mines and released the self -bonds. The Division is in <br />the process of returning the self -bonds to Peabody Investments Corporation. <br />This Division is available to meet with OSMRE to discuss the new Peabody corporate sureties, the TDNs <br />and the Division's response, if necessary.
