January 2016 <br />Energy Fuels Coal, Inc. SL -04 Application for Partial Bond Release - Revised 04/03/16 <br />and maintenance requirements for almost all of the disturbance at the Mine Site and Loadout Area. <br />10. LIABILTY RELEASE FOR MAGPIE SPRING STRUCTURE AREA <br />Phase II and III release of liability is requested for the 0.3 acres surrounding the Magpie spring <br />structure; an area specifically excluded from the SL -03 application for bond release. This area en- <br />compasses the spring location, including approximately 50 feet upstream, and the full length (ap- <br />prox. 150 feet) of the delivery pipe underlying the rip -rap channel of Magpie Diversion. The <br />Magpie spring structure area is shown on the accompanying Bond Release Map. <br />Although EFCI believes that the developed spring can remain based on analytical quality testing, we <br />have signed an agreement with the landowner to reclaim the spring development structure. <br />CONCLUSION <br />EFCI has, at this time, completed the vast amount of the final reclamation of the Southfield Mine <br />area. Vegetation has been successfully established on reclaimed areas as documented in the SL -03 <br />bond release application. All of the boreholes and wells for which EFCI is liable are now sealed or <br />approved for permanent retention. A replacement domestic water well has been drilled at the re- <br />quest of the landowner. Given that EFCI has successfully completed all required reclamation within <br />the mine permit boundary, excepting the small areas noted, EFCI is requesting DRMS approval for <br />release of $36,226 of reclamation bond, release of liability of specific boreholes and wells, release <br />of liability for all but 0.8 acres of the approximate 2713.3 acre mine permit area. <br />Page 8 <br />
