January 2016 <br />Energy Fuels Coal, Inc. SL -04 Application for Partial Bond Release - Revised 04103116 <br />C-1981-014, Loadout Area, Phase 1 Bond Release ". This bond release granted a Phase I release of <br />14.5 acres at the Southfield coal loadout area. SL -02 was approved on April 25, 2003 and docu- <br />mented by the written findings titled "Findings of Compliance and Proposed Decision for a Phase I <br />Bond Release and Bond Reduction SL -02 for Energy Fuels Coal, Inc, Southfield Mine, Permit No. <br />C-1981-014". This bond <br />release granted a Phase I release of 68.6 acres at the Southfield facility area and the refuse disposal <br />area. SL -03, submitted October 13, 2015, was for a Phase I, II, and III bond release of 102 acres at <br />the Southfield mine facility and refuse disposal areas, and Loadout area. This bond release applica- <br />tion is currently under review by the Division. <br />BOND AND LIABLITY RELEASE REQUEST <br />BOND RELEASE AND LIABILTY RELEASE AREAS <br />Phase I, II, and III bond release is requested for two road segments totaling approximately 3.2 acres <br />of disturbance. Bond release is also requested for sealing three (3) monitoring wells, drilling a <br />replacement water well, and for two (2) wells approved for permanent retention. Release of liability <br />is requested for the entire mine permit area, including an area of subsidence hole repair completed <br />in 2012, and excluding two (2) areas of long-term reclamation responsibility. In addition, release of <br />liability is requested for sealing seven (7) boreholes. Detailed information for each of subject items <br />in support of this request for bond and liability release is provided below. <br />A site map showing the relevant bond release areas and structures is included in Appendix C as <br />Bond Release Map, SL -04. This map depicts all items included in this SL -04 request and also <br />shows the two areas excluded from the request to release liability of the entire mine permit area. <br />The two areas are the substation road and adjoining pad site, and the light use road to former MW - <br />NW. The total documented area for these two areas is approximately 0.8 acres. <br />Bond release is also requested for specific tasks included in the Division's 2014 Reclamation Cost <br />Estimate (Cost Estimate) for reclamation and maintenance of the Mine site and Loadout. The <br />Reclamation Cost Estimate, approved with Permit Renewal No. 06, is included in Appendix F. <br />Release of these bond costs are being requested in anticipation of approval of the SL -03 bond <br />release for reclamation covering the vast amount of the Mine Site, and all of the Loadout Area. <br />Please refer to Table 1, SL -04 Bond Release Items, included at the end of this section for a summary <br />description of the items included in this bond release application. This table shows acreages <br />pertaining to specific items, and applicable bond costs associated with each item as documented in <br />the aforementioned DRMS cost estimate. In addition, the basis for the $36,226 of requested bond <br />release is calculated and shown on Table 1. <br />Numerous boreholes and wells are included in this application. For convenience, a list of surveyed <br />coordinates for all of the holes is shown on Table 2. <br />Page 5 <br />
