Box 483 <br />Paonia, Colorado 81428-0483 <br />Subject: Install, own, operate and maintain two <br />Canal, (Bowie Mine No.2 - Technical <br />Dear Mr. Bear: <br />ed Metal Pipes (CMP) across the Fire Mountain <br />49), Paonia Project, Colorado <br />This letter is pursuant to your request to install two (2) CMP structures across the Fire Mountain Canal (Canal) <br />to be located on each side of Consentee's existing bridge. The enclosed Exhibit A shows the approximate <br />location of this crossing. <br />As you know, the Canal is a Federal facility operated <br />District (District) and the Fire Mountain Canal and R <br />associated operation & maintenance (O&M) road rigs <br />and enlarged the Fire Mountain Canal. <br />maintained by the North Fork Water Conservancy <br />,oir Company (Company). The Canal and its <br />-%ay were obtained when the United States acquired <br />The CMP installation crosses a Federal right-of-way (ROW) which is approximately 30 feet wide from <br />centerline on the north side and approximately 33 feet lwide from the centerline on the south side. This ROW <br />is located in the SW '/. of NE '/. of Section 15, Township 13 South, Range 91 West, a P.M. This easement <br />was purchased on October 7, 1949 ftom Nobel A. & Alma E. Baker by the authority of the Canal Act of 1890. <br />The United States, through Reclamation, does not object to the installation of the two CMPs across the Canal <br />and O&M road provided such use does not interfere in? any way -% ith the right acquired or reserved by <br />Reclamation and you, as Consentee, agree to the following conditions: <br />1. The purpose of the two CMPs is to convey non polluted surface runoff water which may occur after <br />a storm event. The CMPs shall be built and maintained so as not to allow any surface runoff water to <br />enter or leek into the Canal. These two CMPs fare to be attached to each side of bridge and not <br />interfere with O&M road traffic. <br />2. The two CMPs will be installed so as not to block or prevent vehicle usage of the O&M roads. The <br />Consentee will provide Reclamation kith as-built drawings within two months of completion of <br />installation. The placement for the two CNTs Twill be located to give at least l8-inches of clearance <br />above the high water level in the Canal when crossing the Canal prison. <br />• <br />• <br />Cl
