STATE HIGHWAY ACCESS PERMIT #399058 June 7, 1999 <br />Issued to Bowie Resources. Inc. <br />TERMS & CONDITIONS <br />1. This pennit is issued in conjunction with Permit N2 399059. SubntinaI for design shall include considerations for <br />all of these permits. (onle one submittal required) If there are any questions regarding this permit. please contact <br />Mike Smith at (970) 248 -7231. <br />'_. The Permutee shall desien and submit for approval a right turn acceleration lane 12 feet in width in conformance <br />with section 4 of the State Highway Access Code, 2 CCR 601 <br />3. Design of this access with auxiliary lanes shall include, at a minimum. 1'h -inch overlay. <br />4. A Notice to Proceed. CDOT Form 1265 is required before beginning the construction of the access or any activity <br />within the highway right -of -way. All submittals, documents, plans and other items that must be completed. shall <br />be submitted and approved before a Notice to Proceed will be issued. Contact the Deparmient (or local issuing <br />authority) for the Notice to Proceed. <br />5, The follo"ing items are required before a Notice to Proceed will be issued: <br />(a) Construction Plans Stamped by a Colorado Registered Professional Engineer. <br />(b) Certificate of Insurance Liability as per Section 2.30 1)(h) of the Access Code. <br />(c) Traffic Control Plan <br />6, The Permittee shall refer to all additional standard requirements on the back of this permit and any enclosed <br />additional terms, conditions, exhibits and noted attachments. <br />7. This Permit is issued in accordance with the State Highway Access Code (2 CCR 601 -1), and is based in part upon <br />the information submitted by the Permiuee. This permit is only for the use and purpose stated in the Application <br />and Permit. Any changes in traffic volumes or type, drainage, or other operational aspects may render this permit <br />void, requiring a new permit to be applied for based upon existing and anticipated future conditions. <br />8. Upon completion of the access, the applicant shall notify the Access Manager by certified mail within 10 days at: <br />Colorado Department of Transportation <br />Mike Smith Region 3 - Access Manager <br />606 South 9s Street <br />Grand Junction, Colorado 81501 <br />9. Nothing in this permit shall prohibit the chief engineer from exercising the right granted in CRS 43 -3 -102 <br />Including but not limited to restricting left hand turns by construction of physical medial separations. <br />10. All costs associated with the installation of traffic lights for this access are the responsibility of the Permittee. This <br />includes but is not limited to the design, construction, utility relocation, testing of materials and inspection. <br />11. Water, sanitary, sewer, gas, electrical, communication, landscaping, and telephone installations will require <br />individual additional permits. <br />12. The Permittee is responsible for obtaining any necessary additional federal, state and /or City /County permits or <br />clearances required for construction of the access. Approval of this access permit does not constitute verification <br />of this action by the Permittee. <br />13. Any work within State Highway right -of -way shall begin after 8:30 A.M. and all work and equipment shall be off <br />the highway BEFORE 3:30 P.M. each day. <br />14. No highway lane closures or one -way traffic will be allowed. <br />15. No work will be allowed at night, Saturdays, Sundays and legal holidays without prior authorization from the <br />Department. The Department may also restrict work within the State Highway right -of -way during adverse <br />weather conditions. <br />16. It is the responsibility of the Permittee to prevent all livestock from entering the State Highway right -of -way at this . <br />access location. Any livestock that does enter the highway right -of -way shall be the sole responsibility of the <br />Permittee. <br />
