(Tri-State) has received your <br />adequacy review letter for MR -96, dated February 29, 2016 and provides the following <br />responses to your comments on behalf of the Western Fuels -Colorado, A Limited Liability <br />Company (Western Fuels -Colorado) New Horizon Mine. <br />Section 2.03.4(6)(a) Legal or Equitable Owners of Record <br />1. In the Coal Ownership section (page 2.03-7), 9 -Richards is not on the proposed list but is <br />listed on Map 2.03.4-2. Please clarify if Richards is still the current coal owner. <br />Response: The Coal Ownership section and Map 2.03.4-2 have both been updated to <br />clarify that the current coal owner of Tract #9 is James and Mariellen Martin. <br />Section 2.03.4(7) Names and Addresses of Contiguous Owners <br />On Map 2.03.4-2, the contiguous subsurface owner north of 1 -Benson and 9 -Richards is <br />not clearly identified. Please clam this subsurface owner. <br />Response: Map 2.03.4-2 has been updated to identify the current owner of this tract as <br />Western Fuels -Colorado. <br />2. In the Oil, Gas and Mineral Ownership section (page 2.03-12 and -13), contiguous <br />mineral owners 21 -City of Nucla, 27-Hainey, 33 -Wilson, 44 -Morgan and 50 -Wilcox are <br />not listed. Please clarify if these mineral owners are still the current owner. <br />Response: The current owners of the contiguous tracts listed above have been identified <br />and this information has been provided in both the Oil, Gas, and Mineral Ownership <br />section and on Map 2.03.4-2. <br />Section 2.03.9 Personal Injury and Property Damage Insurance Information <br />1.
