Cunningham <br /> RE: CMC 287923; File P-2016-004; [PURPORTED] Need for Notice of Intent to <br /> Conduct Prospecting <br /> Dear Mr. Cunningham, <br /> The USFS has apparently forwarded our voluntary NOI to your agency and you think <br /> we MIGHT be prospecting in such a manner that requires a state prospecting permit <br /> and financial guarantee.A MOU between the feds and state of CO allows CO to <br /> process NOIs. However, our filing of a NOI was a courtesy to the USFS as we are only <br /> engaged in non-notice activities. <br /> 1.We are NOT prospecting as defined by the State of Colorado. <br /> We contemplate (after securing key access from the USFS to openings they secured) <br /> to engage in : "Activities which cause very little or no disturbance, including use of <br /> hand carried instruments and devices to make magnetic, radioactive or other tests <br /> and measurements.We will engage in location work, surveying and other work <br /> which causes no greater land disturbance than is caused by the ordinary, lawful use <br /> of the land by persons not prospecting." <br /> "We will engage in a single activity which results in the disturbance of a single block <br /> of land totaling less than 1600 square feet and no more than two such disturbances <br /> per acre. <br /> We represent that the cumulative total of such disturbances will not exceed five <br /> acres statewide in any prospecting operation extending over 24 consecutive <br /> months." <br />
