PERMIT #: M-2004-052 <br />INSPECTOR’S INITIALS: ERR <br />INSPECTION DATE: March 9, 2016 <br /> <br />PROBLEMS/POSSIBLE VIOLATIONS <br /> <br /> <br />INSPECTION TOPIC: Off-site Damage <br />POSSIBLE VIOLATION: Land has been affected outside of the approved permit boundary. This is a possible <br />violation of C.R.S. 34-32.5-116(4)(i) for failure to protect areas outside of the affected land from slides or <br />damages occurring during the mining operation. <br />CORRECTIVE ACTIONS: This possible violation has been scheduled to be considered by the Mined Land <br />Reclamation Board, during the April 27-28, 2016 Board meeting. Official notice of the schedule and other details <br />for the MLRB hearing will be provided under a separate document to be sent via certified mail to the operator. <br />CORRECTIVE ACTION DUE DATE: April 27, 2016 <br /> <br />INSPECTION TOPIC: Sediment Control <br />POSSIBLE VIOLATION: Evidence of uncontrolled erosion to the affected lands was observed. This is a <br />possible violation of C.R.S. 34-32.5-116(4)(j) for failure to stabilize and protect all surface areas of the affected <br />land to effectively control erosion. <br />CORRECTIVE ACTIONS: This possible violation has been scheduled to be considered by the Mined Land <br />Reclamation Board, during the April 27-28, 2016 Board meeting. Official notice of the schedule and other details <br />for the MLRB hearing will be provided under a separate document to be sent via certified mail to the operator. <br />CORRECTIVE ACTION DUE DATE: April 27, 2016 <br /> <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM: The affected area boundary markers are missing or incorrectly placed. This is a problem for failure <br />to maintain boundary markers around the affected area as required by Rule 3.1.12(2). <br />CORRECTIVE ACTIONS: The operator shall conduct a survey and replace the boundary markers in the <br />correct location(s). The operator shall provide photographic proof to the Division that this has been done by the <br />corrective action date. <br />CORRECTIVE ACTION DUE DATE: April 24, 2016 <br /> <br /> <br />OBSERVATIONS <br /> <br />The Division of Reclamation, Mining and Safety (Division/DRMS) conducted an inspection of the Rafert Pit <br />(Permit File No. M-2004-052), a Construction Material Limited 110c Operation Reclamation Permit with 9.9 <br />permitted acres and an approved post mining land use of Cropland. The mine is located approximately 8 miles <br />east-northeast of Holyoke, Colorado. Elliott Russell, with the Division, inspected the site. Randy Schafer <br />represented the Operator and accompanied the inspection. This inspection was carried out as a part of the <br />Division’s normal monitoring program. <br /> <br />At 1220 hours, the Division met Mr. Schafer at the mine site, located north of County Road 26, one half mile <br />east of County Road 53. At the time of the inspection the temperature was hot, the sky was clear, and the <br />ground was dry. The mine site identification sign was posted County Road 26 and was in compliance with Rule <br />3.1.12(1). The permit boundary was delineated by a fence on the east, north, and west sides of the permit. A pile <br />of wood posts near the southeast corner indicated that there was once a fence along the southern boundary, but <br />no boundary marker was found delineating the southeast corner; this has been cited as a compliance problem <br />requiring the Operator to establish a marker before the corrective action due date. <br /> <br />The site consists of a single excavated pit and a large topsoil stockpile along the northern boundary.
