King Coal Mine (C-1981-035) TR -26 Adequacy Review #1 Response <br />H. Rule 4.02.7 Topsoil Markers <br />Where topsoil piles or other soil is segregated and stockpiled the material should be marked and disturbance <br />markers should also be placed. <br />GCCE Mar 2016: Drill pads will be constructed and maintained as per rule 4.06. Soils will be stored at the well <br />sites and protected and signed as per rule 4.06. Text has been added to 2.05.4 to address this subject. <br />I. Rule 2.03.6 Right of Entry <br />Section 2.04.6 page 8 of revised pages states that the roads to the monitoring well locations are controlled by <br />Ute Mountain Ute Tribe, Bureau of Land Management (BLM) and the Wiedemann's. <br />Section 2.04.9 page 3, and section 2.04. 10 page 2 and section 2.04.11 page 3 of revised pages states that the <br />monitoring wells will be drilled on land owned by State of Colorado Lease CO -3388, BLM and the <br />Wiedemann's. <br />13. DRMS Nov 2015: Do you have permission from surface and mineral owners for this activity? <br />GCCE Mar 2016: Cluster MW -2 is to be drilled on State of Colorado Lease CO -3388 and is within the current <br />CDRMS permit boundary. The location has received cultural and environmental clearances and was bonded as part <br />of TR -22. GCCE is preparing BLM form SF 299 for a right_ofwav for Cluster MW -1. The Wiedemann family has <br />been contacted and negotiations are ongoing for property access to Clusters MW -3 and MW -4. Right -of -access <br />information will be forwarded to the Division when finalized and prior to well construction. <br />J. Revised Sections <br />Because there are a number of technical revisions under simultaneous review tracking revised pages is <br />challenging. <br />14. DRMS Nov 2015: Please submit a list of the revised pages for TR26. <br />GCCE Mar 2016: A list of revised pages was previously submitted to the Division for TR -20, TR -24 and TR -26. We <br />have been informed that approval of TR -24 is forthcoming. The revised pages list will be updated once TR -24 is <br />finalized. <br />Revised pages section 2.04.4 page 1 for the King II Mine reference an Appendix 3(4), a Cultural Resources <br />Survey. No such document was included in the original submission of TR26. <br />15. DRMS Nov 2015: Once Stratified Environmental and Archaeological Services (SEAS) has conducted <br />the Cultural Resource Survey (Appendix 3(4)), please submit this document to DRMS for review. <br />GCCE Mar 2016: The cultural resource survey will be submitted when finalized. <br />King II Mine section 2.04.6 page 6 does not flow correctly from the preceding page in the permit and it appears <br />that discrepancies exist regarding the number of exploration bore holes drilled (TR22). <br />16. DRMS Nov 2015: Please assure that all necessary information is included between page transitions. <br />GCCE Mar 2016: Every effort has been made to correct page transitions. However, due to having 3 active <br />Technical Revisions in progress that affect many of the same permit sections, some additional corrections may be <br />
