u <br />Colorado Division of Reclamation, Mining & Safety <br />March 31, 2016 <br />Page 9 <br />ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED TO OCCUR, <br />WHICHEVER IS SOONER. <br />Response: This stipulation requires that a groundwater monitoring well be installed into the <br />Trout Creek Sandstone by the end of the year 2016, and as the stipulation reads, the minor <br />revision to update the PAP must be submitted (it is unclear if approved) by the end of the year <br />2016. The stipulation allows for some flexibility, but it is requested that the Divisions remove <br />the end of year 2016 commitment from the stipulation. Colowyo will be more than willing to <br />commit to installing the groundwater monitoring well prior to ground disturbing activities <br />occurring within the footprint of the Collom Pit (i.e. topsoil stripping for the box cut). It would <br />also be requested that the stipulation be revised to require the minor revision be submitted no <br />later than 90 days after completion of drilling the monitoring well. Finally, Colowyo requests <br />that the aquifer testing commitment be removed from this stipulation. The testing of this well for <br />aquifer properties will not provide any additional data over that which has already been obtained <br />from the aquifer tests performed for the three Trout Creek wells drilled and tested in 1995 and <br />1996 (wells W-95-15, W-95-02, and UL -95-45). Colowyo submits that the well will be <br />developed and sampled for water quality, but the work required to perform a single aquifer test <br />provides no new data, since the well will only be monitoring water quality over the long term. <br />ITEM 81. The response is adequate, but the following stipulations will be added to the Colowyo <br />Mine permit. <br />Stipulation 19: DE WA TERING WELL PERMITS MUST BE IN PLACE, AND THE <br />PERMIT APPLICATION PACKET UPDATED ACCORDINGL Y, BEFORE ANY <br />DISTURBANCE ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED TO <br />OCCUR. <br />Response: In accordance with Rule 2.03.10, once all dewatering well permits associated with the <br />dewatering plan are obtained, Colowyo will update Volume 1 Section 2.03.10 — Identification of <br />Other Licenses and Permits. Colowyo requests that the Division revise the stipulation language <br />to state, "DEWATERING WELL PERMITS MUST BE IN PLACE, AND A MINOR <br />REVISION BE SUBMITTED AND APPROVED BY THE DIVISION TO UPDATE SECTION <br />2.03.10 OF VOLUME 1 OF THE PERMIT APPLICATION PACKAGE, BEFORE ANY <br />DISTURBANCE ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED TO <br />Stipulation 20: A DISCHARGE PERMIT FOR WATER PUMPED FROM DEWATERING <br />WELLS MUST BE IN PLACE, AND THE PERMIT APPLICATION PACKET UPDATED <br />ACCORDINGLY, BEFORE ANY DISTURBANCE ASSOCIA TED WITH THE COLLOM <br />PIT BOX CUT IS ALLOWED TO OCCUR. <br />AN EQUAL OPPORTUNITY /AFFIRMATIVEACTIONEMPLOi'ER <br />°A Touchstone Energy°Cooperative 0 <br />
