A copy of the letter from the landowner of record where SP 1 will be located has been provided <br />below which consents with the location and design of SP I. <br />March 11, 2016 <br />Rick Wolney <br />Mine Manager <br />New Horizon Mine <br />P.O. Box 628 <br />Nucla, CO 81424 <br />Dear Rick: <br />I understand that the DRMS has requested a consent letter from me regarding the stock watering <br />pond to be constructed on my property, Lot 2 of Section 6, T46N, RI 5W, N.M.P.M., Montrose <br />County, Colorado. <br />I inherited this property from my parents, Kenneth E. Goforth and Joyce A. Goforth. They <br />bought the property and signed a mining lease with Peabody Coal in early 1988. <br />During the whole time that my family and I lived on the property, we always understood the <br />western property boundary to be marked by a fence that ran north to south. That fence was <br />removed in the early 1990s to allow mining, but a corner of the fence and remnants of the fence <br />still exist there to this day in the northwest comer of the property, and extending a little bit to the <br />south of there. Our property extends in a westerly direction up to the fence line. <br />Our neighbor to the west until 2012 was the San Miguel Power Company. I do not remember <br />them ever disputing or questioning the location of the property boundary at the fence line. My <br />family never had a dispute with them about that question either. <br />I am familiar with the location where you are proposing to build the stock pond. The stock <br />watering pond always used to be located on the east side of the fence line, in the northwest <br />corner of our property. Our family owned and used the stock pond, but San Miguel Power <br />Company never did. I own the property where Western Fuels -Colorado is proposing to build the <br />replacement stock pond. I consent to you building it there, and have no objections to the design <br />for the pond that you have shown me. <br />Sincerely, <br />Lester F.
