Public Notice

The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the Colorado
Revised Statutes, hereby issues notice that on April 1, 2016, a minor revision application (MR-295) to the
Foidel Creek Mine, Permit No. C-1982-056, operated by Twentymile Coal, LLC, 29515 Routt County
Road No. 27, Oak Creek, CO 80467 was considered complete for the purposes of filing. Twentymile
Coal, LLC. is seeking a revision to the permit to conduct geotechnical investigations for a possible passive
treatment system. The geotechnical investigations will involve completion of eight backhoe test-pits to
depths of approximately 15 feet; physical examination of the soil profile, and collection, examination, and
testing of soil samples. No new roads are proposed to be constructed for this project. Each test-pit will be
backfilled on completion of sampling with the excavated material and leveled. The test-pit locations will
be seeded in the spring. Twentymile Coal, LLC. indicates an increase in disturbed and affected area of .1
acres will result from these investigations. Given the increase in surface disturbance, an increase in
reclamation liability will be evaluated. The applicant is proposing additional surface disturbance outside
of the area currently approved for disturbance. All reviews and comment periods as provided in the Act
and Regulations promulgated thereunder initiate from this date of filing.

Posted April 1, 2016

C-MR-03
