Box 1484 <br />Idaho Springs, CO 80452 <br />RE: Phoenix Mine; DRMS File No. M-1982-075; Withdrawal of Temporary Cessation <br />Requirement <br />Dear Mr. Mosch, <br />The Division of Reclamation, Mining and Safety (Division) conducted an inspection of the <br />Phoenix Mine on January 21, 2016. In the inspection report dated February 3, 2016, the Division <br />cited a problem for failing to comply with the requirements for temporary cessation of mining <br />activities outlined in Rule 1.13.5. On March 23, 2016, the Division received a request for <br />temporary cessation and a Technical Revision application to update and clarify the Reclamation <br />Plan. The Technical Revision application specified that the Operator is now pursuing <br />reclamation in an effort to release the Reclamation Permit for the Phoenix Mine. <br />During a telephone conversation on March 31, 2016, you reiterated that reclamation activities at <br />the Phoenix Mine are under way and there are no plans to resume mining in the future. <br />Therefore, the Division has withdrawn the requirement to place the mine into temporary <br />cessation.
