Included in the Application submittal for the Puma City Mine was a request to be exempt from <br /> the permitting requirements for NOI's. <br /> The request for exemption from the NOI permitting requirements references the 1,600 square foot <br /> exemption contained within the definition of prospecting.Pursuant to Hard Rock Rule 1.1(43),prospecting <br /> does not include any single activity which results in disturbance of a single block of land totaling one <br /> thousand six hundred square feet or less of the land's surface. The Division acknowledges the proposed <br /> operation for the Puma City Mine will result in a surface disturbance of less than 1,600 square feet. In <br /> addition to minor surface disturbance, the proposed operation also calls for entering the underground <br /> workings of the mine to collect bulk samples. The definition of prospecting includes, but is not limited to, <br /> sinking shafts, tunneling, drilling core and bore holes and digging pits or cuts and other works for the <br /> purpose of extracting samples prior to commencement of development or extraction operations. <br /> Therefore, since a portion of the proposed operation meets the statutory definition of prospecting,the <br /> entire project will be subject to all of the Hard Rock rules and regulations pertaining to NOI's.Any <br /> appeal of an Office determination shall follow the procedures set forth in Rule 1.4.11. <br /> If you have any questions,you may contact me at(303)866-3567 x8116. <br /> Sincerely, <br /> Michael A.
