COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
Memo to File
Date: March 23, 2016
From: Michael A. Cunningham
RE: Beaver Creek Site; DRMS File M-2016-019; Notice of Possible Illegal Operation
The Division of Reclamation, Mining and Safety (Division) received notification from the Park
County Planning Department on March 22, 2016 of a possible illegal mining operation. Park
County was initially notified of this activity in 2015. The alleged mining activity is located at
1540 Beaver Creek Rd. in Fairplay, Colorado on private property owned by Mr. James Hastings.
The Division spoke with Mr. Hastings by telephone on March 22, 2016. Mr. Hastings informed
the Division that he has removed material from historic dredge piles along Beaver Creek to
construct a road to a future home site. In addition, Mr. Hastings stated he has leveled some of the
historic dredge piles, covered them with topsoil and attempted to reestablish willows along the
banks of Beaver Creek. Mr. Hastings stated that no material has been sold or has left the site.
According to Mr. Hastings, Park County officials have met with him on site and are aware of the
activity. The Division will coordinate an inspection of the site with Mr. Hastings when the
weather allows for site access.
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
